A lawsuit has been filed against Jackson County and the private property owners/representatives who gave the county easement to build Green Circle Parkway, which leads into the Green Circle BioEnergy plant near Cottondale.
The private owner continues to hold title to the easement property, but now wants to give it to the county in light of a lawsuit filed by adjacent landowner Jacqueline Farren.
Farren claims she owns a portion of the easement property and is seeking damages alleging that a gate, planted trees and other improvements she’d made to the land had been removed in course of building the road.
In a letter to commissioners, the entire easement for Green Circle Parkway was offered to the county. Representing Lara Brewton Povencher and Powell Brewton, trustee of the Lara Brewton Trust, the Apgar and Spiers PL firm sent the letter near the end of January.
But Jackson County Commissioners voted earlier this month not to take title by a quitclaim deed as suggested in the letter. Doing so would have released those parties from the lawsuit, as Farren had reportedly agreed to drop the private owners from the action if they were to extricate themselves from the title ownership.
