The state of Florida has dropped the sexual abuse charges that kept a local man in the county jail for more than two years awaiting trial.
Robert Dominello was freed after the state elected not to prosecute the case, citing potential credibility problems with Dominello’s accuser.
In announcing the state’s decision, Assistant State Prosecutor Shad Redmon wrote that the girl had accused several other people and the family dog of abusing her, with all the alleged instances deemed unfounded. The accuser “is not very oriented to place and time,” he added.
Redmon also pointed out the difference of medical opinion as to whether the girl showed physical signs of injury. While one doctor with the local Sexual Abuse Response Team had indicated the presence of injury, two other doctors doing follow-up said the girl’s body was normal and showed no sign of injury.
Redmon also pointed out that the one doctor who indicated injury in this case had been contradicted by the opinions of two other physicians in a difference sex abuse trial in which she also indicated injury.
Redmon also cited the fact that the girl had been involved in a different court case in which she had been found incompetent to testify, the judge saying she had given statements that were “not reliable, and untrustworthy.”
Redmon also said Dominello had taken a polygraph test and “passed it with flying colors,” according to the examiner.
Dominello’s lawyer, Clyde Taylor, praised Redmon as a state attorney, saying he “kept a very fair and open ear” as he and state attorney Glenn Hess were working their way through to a decision on the case.
Taylor said that his client is relieved the ordeal is over.
